John Loomes (1798 - 1835)
This is the last Will and
Testament of me John Loomes of Husbands Bosworth in the county of Leicester
grazier. I give and Devise and Bequeath all my real and personal property
estate and effects whatsoever and wherever the same may be in position and
coming to me under the Will of my late father and my mother deceased and also
my brother Thomas’s share under the same Will which I purchased of him and all
other my real and personal estate and effects whatsoever and wherever the same
may be unto my brother-in-law John Spencer of Welford in the County of
Northampton, Grazier and my friend Benjamin Jackson in the County of Leicester,
Draper, and to their heirs, executors, administrators and assigns in trust that
my said Trustees or the survivors of them shall sell and dispose of my said
real and personal estates as soon as the nature of such property will permit
and after paying my just debts, funeral expenses and the charges of proving
this my Will pay and discharge of a certain Bond for five hundred pounds with
all interest the rest due and owing from this and then In Trust to put and
place the rest residue and the remainder of my said properties and monies out
of interest either in public funds or else upon one or more good and sufficient
security or securities either real or personal and shall and do pay and apply
the interests and dividends or produce thereof as the same shall arise and be
received unto and for the use of my daughter Elizabeth Loomes and for the
bringing up and proper education of her my said daughter until she arrive of
her age of twenty one and immediately after my said daughter arrive at her said
age of twenty one years upon trust that they my said Trustees or
the survivors of them, his heirs, executors or administrators shall and do call
in the said principal monies and pay the same unto my said daughter Elizabeth
Loomes to and for her own and absolute use and benefit but in the case of my
said daughter should depart this life before attaining her said age of twenty
one years then I direct my said Trustees or Trustee for the time being to call
in my said monies and pay and divide the same and in manner following the
shares I bought of my brother Thomas unto him absolutely in full and other
monies I may have received of my father in law William be with all other of my
property whatsoever and wheresoever and then the remainder unto and equally
between my brothers Thomas, William, James, Charles, George, Benjamin, Sarah,
Jane and Frances Mary to and for their and each of their own absolute uses and
benefit as tenants in concession and I do hereby direct that the receipt or
receipts of my said Trustee or Trustees for the time being shall be on
sufficient discharge or sufficient discharges to any purchaser or purchasers of
my real estate if any for his, her or their purchase money or for so much
thereof as in such receipt or receipts shall be expressed and set forth to have
been received and that such purchaser or purchasers shall not be available or
accountable for any cost misapplication or non application thereof or any part
thereof and I do hereby direct that they my said Trustees and the survivor of
them and their executors or administrators of such survivor of all and may.
reimburse him, her on themselves only of the said trust monies all costs and
charges they may be of by reason of the trust hereby in them reposed and
also that they shall not be charged with an accountable for more of the said Trust
Monies that them shall receive and that one of them shall not be answerable for
the other of them or for the acts, deeds, receipts or payments of the other of
them for his own acts, deeds, receipts or payment only and lastly I do hereby
nominate, constitute and appoint the said John Spencer and Benjamin Jackson
joint executors of this my Will hereby revoking all other Wills by me of any
time hereto fore made. In witness whereas I the said John Loomes have to
this my last Will and Testament set my hand and seal this twenty first
day of February in the year of our Lord One Thousand, Eight Hundred and
Thirty Five

by the said John Loomes the Testator as and for his last Will and Testament in
the presence of us who in his presence and his request and in the presence of
each other have subscribed our names as witnesses hereto and the
interconnection between the first and seventh line on the last page and the
words unto him my said father in law for his own use and benefit
